Housing and Homelessness update from Mick Brosnan
For the record –
Despite the quite misleading report from the CEO that the Bega Valley Shire Council ” has decided to publish … “, the reality is that the Bega Council staff were advised through the first GIPA application under the freedom of information act to realise what now transpires to be a very weak and ineffectual legal position. Subsequently when they denied this request to disclose, the Privacy Commissioner ALSO advised the council to release this convoluted legal document. Bega council staff again refused. So in fact it was the third decision against our council staff , the recent NCAT directive, that ORDERED the release of their legal advice to the Bega Valley community .
We now know that our SJA legal advice given to the council last October, still presents a concise and clear analysis of the status of SJA ‘s crisis transitional units / moveable dwellings.
Council staff insist there is now pathway, safety issues sited without evidence or examples, however other councils and even the State Housing minister has said there are ways forward. Prevarication on the basis of this legal advice has simply stalled our council staff from doing something for our homeless which is after all what the ratepayers are demanding. A shameful train of events that again has been disguised as something else by the Bega Valley CEO .
